AGREEMENT BETWEEN USER AND BOOKTODAY

By booking accommodation online through Book Today I agree to the following terms and conditions:

1. Welcome to BookToday

The terms of use as outlined in this agreement are between ByPeople Technologies Australia Pty Ltd t/a BookToday (BookToday) a company with its registered address as 7/6 Energy Circuit, Robina, Queensland 4226 Australia formed under the laws of Australia and the User of this Web Application (WebApp).

The use of BookToday’s WebApp for any services is subject to the terms and conditions within this agreement. By using this WebApp you agree that these Terms are enforceable in arbitration and court. If you do not agree to these Terms, then please do not use our WebApp.

2. BookToday’s Responsibility

BookToday’s WebApp is a hotel, and other services, search engine. It is BookToday’s goal to assist you in finding the best possible booking given your search criteria. Under no circumstances are any of the hotels featured on this WebApp owned, controlled or made available by BookToday. Strictly speaking the Hotel Providers are responsible for the Product.

The booking of a Hotel Product takes place directly with the Hotel Provider. The Hotel Provider’s terms and conditions as well as privacy policies apply to your booking, so you must agree to, and understand those terms also. Your interaction with any Hotel Provider through our Platform is at your own risk. BookToday does not have any responsibility if anything goes wrong with your booking. BookToday has no control over the Hotel Products or Hotel Providers.

The purpose of BookToday’s WebApp is to host Content, including but not limited to; prices, images User; comments, ratings and other information. BookToday is not responsible for the accuracy, quality or timeliness of the Content. BookToday does not have any influence over the Content entered.

It is the responsibility of the Hotel to update its own Content and pricing. The Hotel may contact you directly to reconfirm pricing related to your booking request. The rates and reviews on BookToday’s WebApp should be used only as a guideline.

3. Booking Submissions

BookToday’s WebApp enables the User to deal directly with the Hotel to facilitate a booking by way of request. Your booking request is submitted by BookToday by forwarding on all the relevant information to the Hotel Provider. Your booking is made official once the Hotel Provider sends the User written confirmation within two days advising that the booking has been accepted. The contract for your booking is therefore made between you and the Hotel Provider.

BookToday has no responsibility for the booking or the Hotel Product because BookToday is not involved in creating the description of the Hotel Product, in defining the price and any fees, and in providing the Hotel Products that you book. If you have any issues or disputes regarding your booking or the Hotel Product, you will need to address these concerns with the Hotel Provider and not with BookToday.

4. Use of the Platform

To make use of this WebApp you agree that:

  • you are legally authorized to create a legally binding obligation
  • you are 18 years or older;
  • all information supplied by you is accurate and current; and
  • BookToday had not previously denied you the right to use our WebApp;
  • All prices are displayed as a per night cost; and

5. Prohibited Activities

If your activity on BookToday’s WebApp is determined to represent signs of fraud or suspicious activity BookToday may deny its services to you. Should the activity seem suspicious then BookToday reserves the right to close your account. If you wish to contest any account closures please contact the support team on support@booktoday.com.au .

6. Privacy Policy

Please review our most recent Privacy Policy available on our WebApp.

7. The Extent of our Liability

All Hotel Providers are welcome to list their Hotel on BookToday. If the Product is listed on BookToday’s WebApp this does not constitute a recommendation by BookToday of that Hotel Product or that Content.

BookToday will not be liable for any cancellation, overbooking, strike, force majeure or other causes beyond its direct control.

8. Indemnity

You agree to indemnify BookToday and its directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

  • your breach of these Terms of Use;
  • your violation of any law or the rights of a third party; or
  • your use of our WebApp.

9. Dispute Resolution

BookToday is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns.

You agree to give us an opportunity to resolve any disputes or claims relating in any way to the WebApp. Notice of your request to remedy a dispute must be submitted by email to support@booktoday.com.au. If we are not able to resolve your Claims within 60 days, you may seek relief through arbitration or in small claims court.

10. Other

If any part of these Terms is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired.
